Terms and Conditions of Use Agreement
PLEASE READ THE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS SITE. We maintain this web site as a service to our customers, and by using our site and/or completing a purchase, you are agreeing to comply with and be bound by the following terms of use. Please review the following terms and conditions carefully, and check them periodically for changes. If you do not agree to the terms and conditions, you should not review information or obtain goods, services or products from this site.
Acceptance of Agreement. You agree to the terms and conditions outlined in this Terms and Conditions of use Agreement ("Agreement") with respect to our site (the "Site"). This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended by us at any time and from time to time without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site.
Copyright. The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks, registered trademarks and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of the Site, except as allowed by Section 4, is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through the Site. The posting of information or materials on the Site does not constitute a waiver of any right in such information and materials.
Limited Right to Use. The viewing, printing or downloading of any content, graphic, form or document from the Site grants you only a limited, nonexclusive license for use solely by you for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works or other use. No part of any content, form or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical.
Editing, Deleting and Modification. We reserve the right in our sole discretion to edit or delete any documents, information or other content appearing on the Site, including this Agreement, without further notice to users of the Site.
Indemnification. You agree to indemnify, defend and hold us and our partners, attorneys, staff and affiliates (collectively, "Affiliated Parties") harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Site, or any goods, including any and all packaging or packing materials; or services purchased from this site.
Disclaimer. THE INFORMATION FROM OR THROUGH THE SITE ARE PROVIDED "AS-IS," "AS AVAILABLE," AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE). THE INFORMATION AND SERVICES MAY CONTAIN BUGS, ERRORS, PROBLEMS OR OTHER LIMITATIONS. WE AND OUR AFFILIATED PARTIES HAVE NO LIABILITY WHATSOEVER FOR YOUR USE OF ANY INFORMATION OR SERVICE. IN PARTICULAR, BUT NOT AS A LIMITATION, WE AND OUR AFFILIATED PARTIES ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LITIGATION, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE NEGATION OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN US. THIS SITE AND THE INFORMATION WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US THROUGH THE SITE SHALL CREATE ANY WARRANTY, REPRESENTATION OR GUARANTEE NOT EXPRESSLY STATED IN THIS AGREEMENT.
Limits. All responsibility or liability for any damages caused by viruses contained within the electronic file containing the form or document is disclaimed. WE WILL NOT BE LIABLE TO YOU FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND THAT MAY RESULT FROM USE OF OR INABILITY TO USE OUR SITE, OR ANY SUBSEQUENT EMAILS, PRODUCTS, OR PACKAGING.† We will not be liable for the unauthorized dissemination or misuse of any information given to us for use in our custom printed items. Our maximum liability to you under all circumstances will be equal to the purchase price you pay for any goods, services or information.
Use of Information. We reserve the right, and you authorize us, to the use and assignment of all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy.
Privacy Policy. Our Privacy Policy , as it may change from time to time, is a part of this Agreement.
Payments. You represent and warrant that if you are purchasing something from us or from our Merchants that (i) any credit card or bank information you supply is true, correct and complete, (i) charges incurred by you will be honored by your credit card or bank company, and (iii) you will pay the charges incurred by you at the posted prices, including any shipping fees and applicable taxes.
Links to Other Web Sites. The Site contains links to other Web sites. We are not responsible for the content, accuracy or opinions express in such Web sites, and such Web sites are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked Web site on our Site does not imply approval or endorsement of the linked Web site by us. If you decide to leave our Site and access these third-party sites, you do so at your own risk.
Submissions. All suggestions, ideas, notes, concepts and other information you may from time to time send to us (collectively, "Submissions") shall be deemed and shall remain our sole property and shall not be subject to any obligation of confidence on our part. Without limiting the foregoing, we shall be deemed to own all known and hereafter existing rights of every kind and nature regarding the Submissions and shall be entitled to unrestricted use of the Submissions for any purpose, without compensation to the provider of the Submissions.
Return Policy. If there is a mistake on a custom printed item on Paperlicious's part, we will reprint and reship (method at our discretion) the item at no cost. If there is a mistake on a custom printed item due to an oversight by the customer, including approving an incorrect proof, we will reprint the items for a 30% discount of purchase price plus shipping. Approved proofs cannot be revised once the order has printed. Paperlicious makes every effort to correct egregious spelling, grammar, and punctuation errors; however due to the large volume of proofs we create, we cannot be responsible for customer mistakes of any kind.
If a package is returned to Paperlicious due to a wrong shipping address given by customers, or because a package is marked "refused" by the USPS, no refund will be given. It is the customer's responsibility to make themselves available for delivery or request a signature release. Packages returned to Paperlicious because the shipper is not available, and/or no redelivery request is made cannot be refunded.
Packages not delivered after the allotted time frame provided by the USPS or UPS cannot be returned or refunded due to circumstances not within our control. We will provide a refund on expedited shipping charges (Express, Next Day, etc.) when a refund is provided to us.
INTERNATIONAL shippers: Shipping charges DO NOT include any duties, taxes, or fees due upon receipt of package. We will declare the full and complete value of the package and mark it as purchased goods, so a duty or tax might be due. We cannot accept returns from outside of the US. The caveat to this is if the printing is our mistake, we will reprint the item for you and reship at our expense using our chosen method. International shipping can take 10-14 days longer than noted so please allow extra time for invitations in your party planning.
We must be notified at cs@ paperlicious.com (removed space) of all mistakes within ten (10) business days. After ten business days, all reprints will be at customer's full expense, no matter the cause. We can only accept returns on stock items. Custom printed items cannot be returned. If our designers determine that a photo is not of the proper quality for a photo card, we will notify the customer of their options. If the customer chooses to still use the photo in question, we will not give refunds for such cards. Once a proof has been created and emailed to the customer, we will only cancel the order and issue a refund minus an $8.50 proof fee. If the order was a RUSH status, we will instead charge the non-refundable $9.95 rush service fee and waive the $8.50 fee. The customer will receive a credit for said charges for a future order, expiring one year from date of issue. In the event that the customer requests a refund on a stock item, no refund will be given until all product is returned to Paperlicious in it's original condition and packaging, at the customer's expense
Invitation, Stationery, and Momager Calling Card proofs are usually emailed in two business days after an order is placed. Photo Card proofs are emailed 2-3 business days after an order is placed. Invitation, Stationery, and Momager Calling Card Orders
usually ship from Paperlicious 2-3 business days after final
proof approval. Photo Cards usually ship 3-4 business days after proof approval. The business day begins the first midnight EST after
an order is placed or a proof is approved (Monday through Friday). For
example, if an order is placed at 2:00pm EST on a Thursday, that order
is considered received on Friday. Then it just depends on your chosen
shipping method. Your order ships from our Georgia location. You will
be notified via automatic USPS or UPS email with your shipping
information. Our hours are 9am-7pm Monday through Friday, excluding
major holidays. Orders received, or orders in progress on
Saturday/Sunday or major holidays will resume on Monday. (Though we do try to work most weekends and holidays too, we don't guarantee order processing on those days.)
In an effort to minimize shipping costs, we offer USPS priority 2-3 day delivery. For priority mail orders, there is a delivery confirmation but no insurance or tracking. We cannot guarantee the timeliness nor performance of this shipping service, though we have found the USPS to be mostly on-time and reliable. We cannot be responsible for lost packages marked undeliverable by the USPS so please assure the accuracy of the shipping address. Should you require an expedited shipping service and/or insurance, we strongly recommend you choose USPS Express Overnight or UPS shipping. Priority orders without insurance confirmed "delivered" by the USPS cannot be refunded if lost, misplaced, or stolen. As a courtesty to our customers, we will gladly reprint these orders for a 30% discount plus shipping. Orders that are never confirmed delivered (except those noted as undeliverable) by the USPS or UPS will be replaced by Paperlicious LLC at our expense. It is the customer's responsibility to make themselves available for delivery or request a signature release. Packages returned to Paperlicious because the shipper is not available, and/or no redelivery request is made, cannot be refunded. Recipients of orders shipping to all international destinations are responsible for all duties and taxes. There is a $1.30 flat handling charge included in each shipping charge.
Venue; Applicable Law. YOU AGREE THAT ALL ACTIONS OR PROCEEDINGS ARISING DIRECTLY OR INDIRECTLY OUT OF THIS AGREEMENT, OR YOUR USE OF THE SITE OR ANY SAMPLES OR PRODUCTS OBTAINED BY YOU THROUGH SUCH USE, SHALL BE LITIGATED IN THE CIRCUIT COURT OF Clarke County, Georgia, OR THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF Georgia. YOU ARE EXPRESSLY SUBMITTING AND CONSENTING IN ADVANCE TO SUCH JURISDICTION IN ANY ACTION OR PROCEEDING IN ANY OF SUCH COURTS, AND ARE WAIVING ANY CLAIM THAT Athens, Georgia OR THE DISTRICT OF Georgia IS AN INCONVENIENT FORUM OR AN IMPROPER FORUM BASED ON LACK OF VENUE. This site is created and controlled by Paperlicious LLC in the State of Georgia, USA. As such, the laws of Georgia will govern the terms and conditions contained in this Agreement and elsewhere throughout the Site, without giving effect to any principles of conflicts of laws.
Paperlicious LLC reserves the right to amend these Terms and Conditions at any time.
